By way of background, an RMP guides the management of lands administered by BLM. The 2025 North Dakota RMP modified the 1988 RMP, including by limiting development of oil and gas in low-potential areas and new coal leasing to areas within four miles of existing mines.

>H.J.Res. 106, which nullifies a Bureau of Land Management rule relating to "Central Yukon Record of Decision and Approved Resources Management Plan";

This joint resolution nullifies the rule submitted by the Bureau of Land Management (BLM) relating to the Record of Decision and Approved Resource Management Plan (RMP) for Alaska’s Central Yukon planning area and issued on November 12, 2024.

By way of background, an RMP guides the management of lands administered by the BLM. This Central Yukon RMP modified the prior RMP for the area, including by designating 21 areas of critical environmental concern or research natural areas, encompassing approximately 3,611,000 acres.

>H.J.Res. 130, which nullifies a Bureau of Land Management rule relating to "Buffalo Field Office Record of Decision and Approved Resources Management Plan Amendment"; and

This joint resolution nullifies the rule submitted by the Bureau of Land Management (BLM) on November 20, 2024, which amended the 2015 resource management plan (RMP) for the Buffalo Field Office in Wyoming to make no federal coal available for future leasing. Thus, the joint resolution requires the BLM to follow the 2015 RMP as it was before it was amended in 2024 and make coal available for leasing.

By way of background, the BLM developed the amendment to the plan in response to Western Organization of Resource Councils v. Bureau of Land Management. In that case, the court held that the BLM must evaluate the climate impacts of federal coal leasing in the Buffalo Field Office and include alternatives to limit or stop coal leasing in the evaluation in order to comply with the National Environmental Policy Act. After conducting the evaluation, the BLM amended the RMP and made BLM-managed coal resources in the Buffalo Field Office planning area unavailable for future leasing.

>H.J.Res. 131, which nullifies a Bureau of Land Management rule relating to "Coastal Plain Oil and Gas Leasing Program Record of Decision."

This joint resolution nullifies the rule submitted by the Bureau of Land Management (BLM), issued on December 9, 2024, and related to the record of decision (ROD) for the program that leases, develops, produces, and transports oil and gas in and from the Coastal Plain program area within the Arctic National Wildlife Refuge.

The 2024 ROD that is being nullified by this resolution replaced the 2020 ROD that made all of the approximately 1.6 million acres of the program area available for oil and gas leasing. The 2024 ROD adopted Alternative D2 in the 2024 Coastal Plain Oil and Gas Leasing Program Final Supplemental Environmental Impact Statement, which made approximately 1.2 million acres unavailable for leasing or exploration in order to protect and conserve resources and certain uses in these areas. However, the 2024 ROD requires the statutory minimum of 400,000 acres to be made available for oil and gas leasing in a specified lease sale, subject to certain stipulations and operating procedures. Under current law, those acres must be located in the areas with the highest potential for the discovery of hydrocarbons.

Letitia James Off The Hook Again As 2nd Grand Jury Refuses To Indict

New York Attorney General Letitia James has dodged yet another bullet from the Trump DOJ, after a second federal grand jury in Alexandria, Virginia declined to indict her on mortgage fraud charges for the second time in a week, after their first case against James was dismissed because a federal judge ruled that Halligan's appointment as interim US attorney was invalid under federal law because she took office after the statutory 120-day interim appointment period had expired.

Apparently "any good prosecutor" cannot get a grand jury to indict a ham sandwich. Or we're not dealing with "any" good prosecutors - as a decision like this from a grand jury is rare due to the fact that only prosecutors appear before them and defendants do not get to offer evidence to rebut the charges.

"For the second time in seven days, the Department of Justice has failed in its clear attempt to fulfill President Trump’s political vendetta against Attorney General James. This unprecedented rejection makes even clearer that this case should never have seen the light of day," said Abbe Lowell, a lawyer representing James. "This case already has been a stain on this Department’s reputation and raises troubling questions about its integrity. Any further attempt to revive these discredited charges would be a mockery of our system of justice."

James was charged with one count of bank fraud and one count of making a false statement in 2020 connected to a home in Norfolk, Virginia. She is accused of indicating on mortgage paperwork that the purchase would be her second home - except she then rented it out and/or let her niece live in it. James denies wrongdoing.

The initial case was prosecuted by Lindsey Halligan, who Trump installed as the acting US attorney for the eastern district of Virginia. While Halligan was able to get a grand jury to indict James, a federal judge dismissed the case - ruling that she was improperly appointed to the post. The effect of the ruling also resulted in the dismissal of the criminal case against former FBI Director James Comey.

Nothing is stopping the DOJ from taking another bite at the apple and refiling the case against James.

President Donald Trump claims to pardon Tina Peters — a power he does not have, experts say

President Donald Trump claimed to grant former Colorado county clerk Tina Peters a “full pardon” Thursday night — a power that constitutional law experts say he cannot wield for a person convicted of state-level crimes.

Peters, 70, is serving a nine-year sentence in state prison in Pueblo for felonies related to providing unauthorized access to voting equipment when she was the elected clerk and recorder of Mesa County. She had worked with prominent election deniers in an attempt to prove discredited claims that voting machines had been manipulated, and she’s been a prominent supporter of Trump’s debunked claims of fraud in the 2020 election.

On Thursday evening, Trump posted to his Truth Social account that “Democrats have been relentless in their targeting of TINA PETERS, a Patriot who simply wanted to make sure that our Elections were Fair and Honest.”

“Tina is sitting in a Colorado prison for the ‘crime’ of demanding Honest Elections,” Trump posted. “Today I am granting Tina a full Pardon for her attempts to expose Voter Fraud in the Rigged 2020 Presidential Election!”

Trump, however, can grant pardons only for federal crimes — not those committed against the state, as Peters was convicted of.

“Trump has the constitutional power to pardon people for crimes against the United States,” Jessica Smith, a Denver-based attorney with the firm Holland and Hart, said of Trump’s post. “Peters was convicted of crimes against Colorado. To suggest he can pardon for state crimes would upend fundamental principles of federalism.”

As of 6 p.m., no formal pardon document had been released on the federal government’s clemency website. An attorney for Peters could not immediately be reached for comment on the president’s post.

An attempted pardon by Trump could be used by Peters’ attorneys as the basis for further filings in state or federal court.

Peters has been treated as a sort of martyr for fellow election conspiracy theorists, including Trump, who’s a fellow Republican. Trump, since his return to office in January, has repeatedly threatened, insulted and otherwise sought to cajole Gov. Jared Polis to give Peters leniency.

Most recently, the Trump administration sought to move her to a federal prison, where his administration would have more say about her conditions. State corrections officials have rejected that request, considering it improper.

On Monday, a federal judge in Colorado ruled that his court didn’t have the authority to release Peters while she appeals her 2024 conviction through the state courts. Peters’ legal team has argued that she should be released because she is ill, because her mother is in the hospital and because she was being held in solitary confinement.

Trump, however, does not have the power to intervene in the state case, according to attorneys who aren’t involved in the case.

Doug Spencer, a constitutional law professor at the University of Colorado, echoed Smith — and warned that Trump’s post may send a dangerous message. He called it “sad that our president hasn’t read or doesn’t understand a basic tenet of the U.S. Constitution.”

“This post carries no legal weight,” Spencer said. “It is a political stunt. And a dangerous one — because it may lead others to believe that he has some power over her case, and that those individuals involved in her case in Colorado have acted inappropriately or illegally, for which there is absolutely no evidence.”

Polis, a Democrat, would have the power to pardon Peters for state crimes. His office did not immediately return a request for comment Thursday evening.

In a statement, Colorado Secretary of State Jena Griswold, also a Democrat, said: “Tina Peters was convicted by a jury of her peers for state crimes in a state court. Trump has no constitutional authority to pardon her. His assault is not just on our democracy, but on states’ rights and the American Constitution.”

Facebook’s second most powerful executive, Sheryl Sandberg, has apologised for the conduct of secret psychological tests on nearly 700,000 users in 2012, which prompted outrage from users and experts alike.

The experiment, revealed by a scientific paper published in the March issue of Proceedings of National Academy of Sciences, hid "a small percentage" of emotional words from peoples' news feeds, without their knowledge, to test what effect that had on the statuses or "likes" that they then posted or reacted to.

“This was part of ongoing research companies do to test different products, and that was what it was; it was poorly communicated,” said Sandberg, Facebook’s chief operating officer while in New Delhi. “And for that communication we apologise. We never meant to upset you.”

The statement by Sandberg, deputy to chief executive Mark Zuckerberg, is a marked climbdown from its insistence on Tuesday that the experiment was covered by its terms of service. The secret tests mean that the company faces an inquiry from the UK's information commissioner, while the publishers of the paper have said they will investigate whether any ethics breach took place. Psychological tests on human subjects have to have "informed consent" from participants - but independent researchers and Facebook have disagreed on whether its terms of service implicitly cover such use.

Facebook’s first public comment on the experiments came as the social network attempted to woo Indian advertisers as part of its efforts to tailor adverts to users outside of the US.The aim of the government-sponsored studywas to see whether positive or negative words in messages would lead to positive or negative content in status updates.

The company's researchers decided after tweaking the content of peoples' "news feeds" that there was "emotional contagion" across the social network, by which people who saw one emotion being expressed would themselves express similar emotions….

By handing out CDLs to ineligible drivers, the state “sent unsafe foreign drivers onto highways across America and put countless families in danger."

Washington state says it accidentally issued nearly 700 commercial driver's licenses over the past seven years to non-US citizens who did not qualify to have them. Washington is a so-called "sanctuary state" for illegal immigrants.

The revelation comes as the Evergreen State sits in the crosshairs of the Trump administration's CDL crackdown following the case of Harjinder Singh, an illegal alien who allegedly made an illegal U-turn in a semi-truck and killed three people in Florida in August. Singh, who crossed the border illegally in 2018, failed the required tests and allegedly did not speak English.

Washington still issued him a commercial driver’s license, which he then used to obtain a California CDL. After the fatal crash, Florida’s attorney general asked the US Supreme Court to permanently bar Washington and California from issuing commercial licenses to noncitizens. Washington has until Jan. 27 to respond.

Transportation Secretary Sean Duffy has since threatened to withhold federal highway funding from states that issue CDLs to immigrants who don’t qualify and has moved to tighten eligibility rules, moves now being litigated. According to the Washington State Standard, the state Department of Licensing (DOL) found 685 CDLs had been wrongly issued over seven years.

A US Department of Transportation spokesperson told the outlet that Washington’s “failure to follow federal law is a blatant breakdown in its responsibility to protect the public,” adding that by handing out CDLs to ineligible drivers, the state “sent unsafe foreign drivers onto highways across America and put countless families in danger. This is exactly the kind of negligence Secretary Duffy is working to eliminate. Following the law is not optional.”

DOL spokesperson Nathan Olson said, “Errors have been addressed, and DOL is working to make changes in our system, process, procedures, and training to prevent mis-issuances in the future.”

The admissions came the same week a Mexican national was arrested after Washington State Patrol said he caused a six-vehicle pileup on I-5 in Lacey when the car-hauling semi he was driving, without a CDL, slammed into the back of a school bus. Troopers said Juan Hernandez-Santos had no commercial license, no insurance, and no valid medical card. He was charged with operating a commercial vehicle without a valid license, a gross misdemeanor. The at-fault carrier is based in California.

Journalist Files Defense in Anti-Semitism Test Case

Mary Kostakidis, a national TV news presenter in Australia for two decades, has asked a federal judge to throw out the Zionist Federation’s charge against her of racially vilifying Jews, reports Joe Lauria.

Embattled Australian journalist Mary Kostakidis has filed her formal defense against the charge by the Zionist Federation of Australia that she is an anti-semite, telling a federal judge the allegation of racial vilification is really intended to smear legitimate criticism of Israel and stifle free speech.

In her 29-page filing, Kostakidis argues that her reporting on Israel’s actions in Gaza did not target Jewish people but the Israeli government. Her posts on X had nothing to do with the “race or national or ethnic origin of Jewish Australians and/or Israeli Australians,” she says.

The Zionist Federation of Australia “instituted the present proceeding vexatiously and without reasonable cause and in bad faith,” the defense argues.

At the heart of the case is whether criticizing Zionism, the secular political movement behind the establishment and governance of the state of Israel, is the same as an anti-semitic, irrational hatred of Jews.

The term “Zionist” is not even defined in the Zionist Federation’s complaint against her, and “may bear a range of meanings,” Kostakidis says. “One definition of Zionism is the ‘aim to establish a Jewish state by taking over as much of historical Palestine as possible and leaving in it as few Palestinians as possible,” she says, quoting from Israeli historian Ilan Pappe and Jewish-American scholar Noam Chomsky in their book On Palestine.

“Zionism is a political philosophy or ideology and not a race or an ethnic group,” the defense says in its filing to Australian Federal Court in Melbourne on Nov. 29.

At issue in this case — and in the three-year battle by critics of Israel against the organized suppression of their views — is whether criticizing a government’s conduct disparages an entire ethnic group.

Kostakidis cites a similar case to hers this year in which a Muslim cleric in Sydney was tried under the same law as in her case. The cleric was found to have made anti-semitic statements, however the judge in the case, Justice Angus Stewart, ruled significantly that:

“Political criticism of Israel, however inflammatory or adversarial, is not by its nature, criticism of Jews in general or based on Jewish racial or ethnic identity. The conclusion that it is not antisemitic to criticise Israel is the corollary of the conclusion that to blame Jews for the actions of Israel is antisemitic; the one flows from the other.”

Israel Used Palantir Technology In Its 2024 Lebanon Pager Attack

Palantir software was used by Israel in its 2024 pager attacks in Lebanon, according to a new book by Alex Karp, co-founder of the Palantir tech company. On September 17, thousands of pagers belonging to Hezbollah members, including civilians not involved in any armed activity, were detonated across Lebanon.

Many showed "error" messages and vibrated loudly prior to exploding, luring Hezbollah members or, in some cases, their family members to stand close by at the point of detonation. The next day more communication devices exploded, including at the public funerals of Hezbollah members and civilians who had been killed the previous day.

While many Israeli figures celebrated, praised and even joked about the attacks, United Nations experts called them a "terrifying" violation of international law. In total, 42 people were killed and thousands wounded, many left with life-altering injuries to the eyes, face and hands.

Karp's new biography reveals that Israel deepened its use of the company’s technology after it launched the war on Gaza in October 2023, deploying it in numerous operations.

"The company’s technology was deployed by the Israelis during military operations in Lebanon in 2024 that decimated Hezbollah’s top leadership," wrote Michael Steinberger, author of The Philosopher in the Valley: Alex Karp, Palantir, and the Rise of the Surveillance State.

"It was also used in Operation Grim Beeper, in which hundreds of Hezbollah fighters were injured and maimed when their pagers and walkie-talkies exploded (the Israelis had booby trapped the devices)."

He said that the demand for Palantir’s assistance by Israel "was so great that the company dispatched a team of engineers from London to help get Israeli users online".

The involvement of a range of tech companies in Israel's attacks on its neighbors in recent years, as well as for attacking and surveilling Palestinians, has sparked anger from rights campaigners and UN officials.

In a report produced by UN Special Rapporteur Francesca Albanese in July, several tech companies were accused of profiting from crimes including illegal occupation, apartheid and genocide in occupied Palestine. The report referenced AI systems that were developed by the Israeli military to process and generate targets during the war on Gaza.

"There are reasonable grounds to believe Palantir has provided automatic predictive policing technology, core defense infrastructure for rapid and scaled-up construction and deployment of military software, and its Artificial Intelligence Platform, which allows real-time battlefield data integration for automated decision making," the report said.
