Former congressional staffer pleads guilty to using access to Congressperson’s bank account to pay her own credit card bills

An Alexandria woman pled guilty today to wire fraud after misusing the financial information of her former employer, a member of the U.S. House of Representatives.

According to court documents, Courtney Melissa Hruska, 40, was employed on the member’s staff from August 2015 to January 2022. To fulfill part of Hruska’s official duties and responsibilities, the member entrusted Hruska with the member’s personal credit card and bank account information. On Jan. 30, 2022, Hruska left the office for a new position with a federal agency.

Without authorization, Hruska retained the member’s personal credit card and bank account information. Between Aug. 19, 2023, and July 30, 2024, Hruska used the member’s bank account information to make payments towards the balance of Hruska’s own personal credit card bills on 10 separate occasions. The member did not use electronic banking and did not receive immediate alerts from the bank. Because more than a year had lapsed between Hruska’s first fraudulent transaction and the member’s discovery of the theft, the member recovered less than nine percent of the stolen funds in fraud compensation.

In total, Hruska caused a loss to the Representative of at least $22,865.07.

Hruska is scheduled to be sentenced on June 23 and faces up to 20 years in prison. A federal district court judge will determine any sentence after considering the U.S. Sentencing Guidelines and other statutory factors.

Gov. DeSantis Moves to Impeach a Judge Who Released a Child Sex Abuser Who Then Killed His Stepdaughter

Florida Governor Ron DeSantis signed a bill into law on Tuesday that requires judges to revoke a person’s bond once they have been convicted of dangerous crimes, including sex offenses.

The legislation, well known as Missy’s Law, was named after 5-year-old Missy Mogle, who was killed in Tallahassee last year.

This story is too horrific to detail. She was sexually abused and killed by her parents, Chloe Spencer, 23, and Daniel Spencer, 25. A retired doctor, who was called a “grandfather,” knew about the abuse but didn’t report it. The grandfather, Dr. Robert Frable, 71, who is not related to the child, tried to resuscitate her the day she died. Later, he was charged with failing to report the abuse.

The child had been tortured and abused over a period of time, with her hands bound behind her back.

She died by asphyxiation.

The mother and stepfather are charged with second-degree murder.

A month earlier, Leon County Judge Tiffany Baker-Carper had released Spencer, a convicted sex offender, on bail pending sentencing for attempting to meet a 15-year-old girl. The judge said she released him because he had been out of jail for a year without violations and had no violent criminal history.

It would be nice to see far more of these impeachments.

Reports keep blaming the system. How is the system involved? Her parents and the judge are responsible. The system didn’t work because of the people involved.

President Donald Trump said he plans to take the extraordinary step of attending Supreme Court oral arguments Wednesday in a case that could end birthright citizenshipin the U.S.

"I'm going," Trump told reporters in the Oval Office on Tuesday. "Because I have listened to this argument for so long."

White House press secretary Karoline Leavitt later confirmed to NBC News that Trump plans to be there Wednesday morning when Supreme Court justices hear arguments on the constitutionalityof a January 2025 executive order he signed that seeks to limit birthright citizenship to people who have at least one parent who is a U.S. citizen or a legal permanent resident.

Both the court and the nonprofit Supreme Court Historical Society said in October that there is no official record of any sitting president having attended oral arguments at the high court.

Trump attended the formal ceremonies at the court confirming his Supreme Court appointees Neil Gorsuch and Brett Kavanaugh, but he has never been there before for arguments.

Trump would be present weeks after his attacks on justices following the court's ruling against his tariffs. At the time, he called justices "disloyal to the Constitution." In the days leading up to oral arguments in that case, Trump indicated he might attend them at the Supreme Courtbut ended up not going.

Richard Pildes, a professor of constitutional law at New York University, said Trump's presence during oral arguments "certainly raises the temperature of the argument, which might be the President’s intent."

"The case is about the powers of the presidency as an institution," Pildes said in an email to NBC News. "By showing up in person, the President would instead be personalizing the case, as if it’s a personal confrontation between him and the justices."

He added that presidents have avoided attending oral arguments because there is an understanding that the court's decisions apply to the presidency as an institution, not to just an individual president's time in office.

“They have understood it’s not good for the country to up the level of confrontation by representing the dispute as a more personalized one through showing up in person,” Pildes said.

While Trump's presence would be unorthodox, he is by no means the first president to publicly comment on a pending case tied closely to a White House agenda. President Barack Obama drew criticism in 2012 after he said the Supreme Court would be taking an “unprecedented, extraordinary step” if it struck down the 2010 Affordable Care Act.

Chief Justice John Roberts has worked hard to keep the Supreme Court independent from the two other branches of government, frequently speaking out against threats to and attacks on the judiciary. Many of those attacks have come from Trump, the head of the executive branch.

"The problem sometimes is that the criticism can move from a focus on legal analysis to personalities," Roberts said March 17. "And you see from all over, I mean, not just any one political perspective on it, that it's more directed in a personal way, and that, frankly, can be actually quite dangerous."

"Personally directed hostility is dangerous and has got to stop," he added.

The Supreme Court agreed in December to hear the case after lower courts ruled against Trump's plan to end automatic birthright citizenship for almost anyone born in the U.S.

The 14th Amendment has long been interpreted to protect birthright citizenship, as it states: “All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States.”

The Trump administration is pushing back against the longtime interpretation of that clause.

The 14th Amendment’s authors would exclude illegal and visiting aliens from U.S. ‘jurisdiction.’

President Trump’s executive order denying birthright citizenship to U.S.-born children of nonresident aliens goes before the Supreme Court Wednesday, and conventional wisdom has it that the president will lose in Trump v. Barbara. If the court stays true to the original meaning of the 14th Amendment’s Citizenship Clause, however, the conventional wisdom will prove wrong.

The clause grants citizenship to persons who meet two conditions: birth in the U.S. and being “subject to the jurisdiction” of the U.S. The dispute is over the meaning of the latter term. Everyone agrees that it excludes at least three classes: children of diplomats, of soldiers from an invading army, and of American Indians maintaining tribal relations. In each of these categories, the status of the child depended on the status of the parent.

The constitutional debate is about the original concept embodied in the text that explains these exclusions and whether that concept embraces or excludes children born on U.S. soil to parents who are unlawfully or temporarily in the U.S. The court has never squarely addressed this question.

Before Mr. Trump’s executive order, what originalist scholarship existed on the original meaning of “subject to the jurisdiction” was sporadic and lightly tested if at all. The past year has produced an explosion of originalist scholarship on both sides. The justices are now in a good position to decide which side has presented the stronger originalist case.

Kurt Lash of the University of Richmond has examined the congressional debates over the 14th Amendment and the Civil Rights Act of 1866. That act declared that “all persons born in the United States and not subject to any foreign power” are citizens. The 14th Amendment was intended to constitutionalize, not alter, the Civil Rights Act. Congress re-enacted the same language after the 14th Amendment was adopted, suggesting an identical operation. But the drafters of the 14th Amendment saw a need for constitutional language that more clearly excluded the children of tribal Indians.

Sen. Lyman Trumbull (R., Ill.), who managed the Citizenship Clause in the upper chamber, explained that “subject to the jurisdiction” meant “not owing allegiance to anybody else,” whether to a tribe or a foreign power. Rep. John Bingham (R., Ohio), the moving force behind the 14th Amendment, used the same framework, referring after ratification to persons born in the U.S. “and not owing allegiance to any foreign power.” These statements, and others Mr. Lash identified, demonstrate how leading Republicans explained the concept the text was meant to capture: birth plus full political membership….

Fresh public criticism of remarks by President MasoudPezeshkian and the defensive response from his inner circle appear to add to signs of a widening rift between the government and the Revolutionary Guards over the conduct of the war and its economic fallout.==

United States v. Wong Kim Ark, 169 U.S. 649 (1898), is a landmark U.S. Supreme Court decision that interpreted the Citizenship Clause of the Fourteenth Amendment and established the principle of birthright citizenship (jus soli) for most people born on U.S. soil.

### Background and Facts

Wong Kim Ark was born in San Francisco in 1873 to Chinese immigrant parents who were subjects of the Emperor of China. His parents had a permanent domicile and residence in the United States, where they ran a business, and were not diplomats or officials of the Chinese government. At the time, the Chinese Exclusion Act (1882) and related laws barred Chinese immigrants from naturalizing as U.S. citizens and severely restricted Chinese immigration.

In 1895, after a temporary visit to China, Wong (then in his early 20s) was denied re-entry to the United States by customs officials in San Francisco. They claimed he was not a U.S. citizen because of his Chinese parentage and the exclusion laws. Wong filed a habeas corpus petition, asserting he was a citizen by birth under the Fourteenth Amendment.

The key question was: Does a child born in the United States to non-citizen parents (specifically, Chinese subjects with permanent residence here) automatically become a U.S. citizen at birth under the clause: “All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the State wherein they reside”?

### The Supreme Court’s Decision

In a 6-2 decision (Justice Joseph McKenna did not participate), the Court ruled in favor of Wong Kim Ark on March 28, 1898. Justice Horace Gray wrote the majority opinion.

The Court held that Wong was a U.S. citizen by birth. The Fourteenth Amendment’s Citizenship Clause affirms the long-standing common-law rule of jus soli (citizenship by place of birth). Anyone born in the United States and “subject to the jurisdiction thereof” is a citizen, regardless of the parents’ race, national origin, or alien status—provided the parents are domiciled residents carrying on business and not in diplomatic or official roles for a foreign government.

The phrase “subject to the jurisdiction thereof” was interpreted in light of English common law: it generally means being within the territory and owing allegiance to the United States (i.e., under its protection and laws). Children of foreign diplomats, those born on foreign public ships, or (in limited historical contexts) children of invading enemies were exceptions. Children of Native American tribes owing direct allegiance to their tribes were also noted as an additional exception at the time, though that was later addressed by statute.

The majority emphasized that the parents’ permanent domicile in the U.S. placed them (and thus their child) under U.S. jurisdiction. The Chinese Exclusion Acts could not override the Constitution’s clear command on citizenship by birth. Wong’s citizenship, acquired at birth, had not been lost by his temporary visit abroad.

Chief Justice Melville Fuller and Justice John Marshall Harlan dissented, arguing (among other points) that citizenship should follow the parents’ allegiance more closely and that the exclusion laws reflected a congressional intent to limit Chinese claims to citizenship.

This case is foundational for modern U.S. birthright citizenship. It confirmed that the Fourteenth Amendment grants automatic citizenship to nearly all persons born on U.S. soil, including children of immigrants who are not eligible for naturalization themselves. It has been cited extensively in immigration law and debates over citizenship, and it remains good law. Congress later codified aspects of birthright citizenship in statutes like the Immigration and Nationality Act.

In short, *Wong Kim Ark* rejected race- or parentage-based barriers to citizenship for those born in the United States and solidified the broad application of the Fourteenth Amendment’s Citizenship Clause.
